PG & Roommate Platform
TERMS AND CONDITIONS

1. Definitions and Interpretation
1.1 Platform
"Platform" refers to the Roommat Living website (www.roommat.in), mobile application, and any associated digital services operated by Roommat Living.
1.2 User
"User" means any individual who accesses, registers on, or uses the Platform in any capacity, including PG seekers, PG owners, property agents, and visitors.
1.3 PG Owner / Host
"PG Owner" or "Host" means any person or entity who lists a Paying Guest accommodation, flat sharing option, or room on the Platform.
1.4 Seeker / Tenant
"Seeker" or "Tenant" means any User who uses the Platform to search for, inquire about, or book accommodation.
1.5 Listing
"Listing" means any PG accommodation, flat, room, or living space posted by a PG Owner on the Platform, including all associated details such as photos, price, and amenities.
1.6 Services
"Services" refers to all features provided by Roommat Living including PG search, roommate matching, flat sharing coordination, owner dashboard, payment facilitation, and related tools.
1.7 Content
"Content" means any text, photos, videos, reviews, data, or other material uploaded, submitted, or shared by Users on the Platform.
2. Acceptance of Terms
2.1 Agreement
By accessing or using the Roommat Living Platform in any way, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions, our Privacy Policy, and any additional guidelines or policies posted on the Platform.
2.2 Age Requirement
You must be at least 18 years of age to use this Platform independently. Users between 16–17 years may use the Platform only with verifiable parental or guardian consent.
2.3 Legal Capacity
By using this Platform, you represent and warrant that you have the legal capacity to enter into a binding agreement under applicable Indian law, including the Indian Contract Act, 1872.
2.4 Modifications
Roommat Living reserves the right to modify these Terms at any time. Updated terms will be posted on the Platform with a revised effective date. Continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
3. User Registration and Account
3.1 Account Creation
To access most features of the Platform, you must create a registered account by providing accurate, complete, and current information including your name, phone number, and email address.
3.2 Verification
Roommat Living may require verification of your identity via Aadhaar OTP, phone OTP, or other methods. PG Owners must complete enhanced verification including property address confirmation before listings are published.
3.3 Account Security
You are solely responsible for maintaining the confidentiality of your account credentials. You agree to notify Roommat Living immediately at support@roommat.in of any unauthorised use of your account.
3.4 Single Account
Each individual or entity may maintain only one active account on the Platform. Creating duplicate or fraudulent accounts is strictly prohibited and may result in permanent suspension.
3.5 Account Termination by User
You may request deletion of your account at any time. Account deletion will remove your profile and listings from public view, but Roommat Living may retain records as required by law or for dispute resolution.
4. PG Listing Rules and Obligations (For Owners)
4.1 Accuracy of Listings
PG Owners must ensure that all listing information is accurate, current, and not misleading. This includes rent price, deposit amount, available rooms, amenities, food offerings, location, and house rules.
4.2 Prohibited Listings
The following types of listings are strictly prohibited on the Platform:
- Listings for properties that do not physically exist
- Duplicate or inflated listings for the same property
- Properties involved in ongoing legal disputes
- Listings that discriminate on the basis of religion, caste, gender, or nationality in violation of Indian law
- Properties without owner's consent or legitimate authority to list
4.3 Photos and Media
All photos uploaded must be genuine images of the actual property. Use of stock photos, AI-generated images, or photos from other properties is strictly prohibited and may result in immediate listing removal and account suspension.
4.4 Real-Time Availability
Owners are required to update bed and room availability within 48 hours of a vacancy being filled. Failure to maintain accurate availability information may result in suspension of the listing or account.
4.5 Pricing Transparency
The listed rent price must be the actual amount charged to tenants. Hidden fees, charges not disclosed in the listing, or bait-and-switch pricing practices are prohibited.
4.6 Owner Responsibility
PG Owners are solely responsible for the safety, habitability, and legal compliance of their property. This includes compliance with local municipal regulations, fire safety norms, and any applicable licensing requirements in Ahmedabad or Gandhinagar.
5. Seeker Rules and Conduct
5.1 Good Faith Inquiries
Seekers must make inquiries in good faith. Sending bulk inquiries without genuine intent, spamming PG owners, or misrepresenting identity when contacting owners is strictly prohibited.
5.2 Verification Documents
Seekers agree to provide valid identification (Aadhaar, PAN, or passport) to PG owners upon request as part of the standard accommodation process. Providing false documents constitutes fraud.
5.3 Roommate Matching
Roommate matching features are provided for informational purposes. Roommat Living does not guarantee compatibility between matched users. Users are responsible for independently verifying the suitability of any potential roommate.
5.4 Direct Agreements
Any tenancy or accommodation agreement entered between a Seeker and a PG Owner is a private contract between those parties. Roommat Living is not a party to such agreements and bears no liability for their terms or execution.
6. Fees, Payments, and Subscriptions
6.1 Basic Listing Free
Creating a standard PG listing on Roommat Living is free of charge. Free listings include standard visibility and basic inquiry features.
6.2 Owner Pro Plan
The Owner Pro Plan is available at Rs.499/month (or as updated on the Platform). This subscription includes featured listing placement, vacancy dashboard, WhatsApp lead alerts, and digital agreement tools. Subscription fees are charged in advance and are non-refundable.
6.3 Featured Listing Boosts
Paid boost packages (ranging from Rs.99 to Rs.299) are available for enhanced visibility. Boost fees are non-refundable once the boost period has commenced.
6.4 Booking Commission
Where bookings are facilitated through the Roommat Living payment gateway, a commission of 3–5% of the first month's rent may be charged. This fee will be clearly disclosed before any transaction is completed.
6.5 Seeker Premium Plans
Seeker premium plans (Rs.199/month or Rs.399/month) provide additional features including unlimited contact views and AI roommate matching. These are billed in advance and are non-refundable once the billing period has begun.
6.6 Payment Processing
All payments on the Platform are processed through Razor pay. By making a payment, you also agree to Razor pay's terms and conditions. Roommat Living does not store credit or debit card details on its servers.
6.7 Taxes
All fees quoted are exclusive of applicable GST or other taxes unless expressly stated otherwise. Users are responsible for any applicable taxes on transactions conducted through the Platform.
6.8 Refund Policy
Subscription fees and boost payments are non-refundable. In cases of proven technical failure by Roommat Living preventing service delivery, a pro-rated refund or service credit may be issued at the company's sole discretion.
7. Content and Intellectual Property
7.1 User Content Licence
By uploading any Content (photos, descriptions, reviews, or other material) to the Platform, you grant Roommat Living a non-exclusive, royalty-free, worldwide, transferable licence to use, reproduce, display, and distribute such Content for the purposes of operating and promoting the Platform.
7.2 Ownership of User Content
You retain ownership of any original Content you upload. You represent and warrant that you have all necessary rights, licences, and consents for any Content you submit, and that your Content does not infringe the intellectual property rights of any third party.
7.3 Roommat Living IP
All intellectual property on the Platform including the Roommat Living brand, logo, software, design, algorithms, and platform architecture is the exclusive property of Roommat Living. No licence to use our intellectual property is granted except as explicitly stated.
7.4 Prohibited Content
You must not upload or share Content that is defamatory, obscene, fraudulent, harassing, discriminatory, or that violates any applicable Indian law including the Information Technology Act, 2000 and its amendments.
7.5 Copyright Complaints
If you believe any Content on the Platform infringes your copyright, please send a written notice to legal@roommat.in with full details of the alleged infringement.
8. Privacy and Data Protection
8.1 Privacy Policy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy carefully to understand our data collection and usage practices.
8.2 Data Collection
Roommat Living collects personal data including name, phone number, email address, location data, and usage patterns for the purposes of operating the Platform, improving services, and sending relevant communications.
8.3 Aadhaar Data
Where Aadhaar-based verification is used, Roommat Living complies with all applicable provisions of the Aadhaar Act and related UIDAI regulations. Aadhaar numbers are not stored in raw form beyond verification requirements.
8.4 Data Sharing
Roommat Living does not sell personal data to third parties. Data may be shared with payment processors (Razorpay), communication platforms (WhatsApp Business API), and analytics services solely for operational purposes.
8.5 Data Rights
Users have the right to request access to, correction of, or deletion of their personal data held by Roommat Living, subject to legal retention obligations. Requests may be submitted to privacy@roommat.in .
9. Prohibited Activities
9.1 General Prohibitions
Users of the Roommat Living Platform must not engage in any of the following activities:
- Creating fake, fraudulent, or misleading listings or profiles
- Scraping, copying, or systematically extracting data from the Platform without written permission
- Using the Platform to conduct or facilitate illegal transactions
- Harassing, threatening, or intimidating other Users
- Circumventing the Platform to avoid paying applicable fees or commissions
- Attempting to gain unauthorised access to the Platform's systems or other User accounts
- Using automated bots, scripts, or tools to interact with the Platform
- Uploading malware, viruses, or any harmful code
- Impersonating Roommat Living staff, other Users, or third parties
- Engaging in discriminatory conduct based on religion, caste, gender, disability, or any other protected characteristic
9.2 Consequences
Violation of these prohibitions may result in immediate account suspension, permanent ban, removal of listings, forfeiture of subscription fees, and where appropriate, referral to law enforcement authorities.
10. Disclaimers and Limitation of Liability
10.1 Platform as Intermediary
Roommat Living is a technology platform that connects PG seekers with PG owners. We are not a real estate agent, property manager, or party to any tenancy agreement. We do not own, operate, or manage any PG property listed on our Platform.
10.2 No Guarantee of Availability
Roommat Living does not guarantee the accuracy, completeness, or current availability of any listing. Room availability may change between a User's inquiry and the actual booking. Always confirm availability directly with the PG owner.
10.3 No Warranty
The Platform is provided on an "as is" and "as available" basis. Roommat Living makes no warranties, express or implied, regarding the Platform's reliability, fitness for a particular purpose, or uninterrupted operation.
10.4 Limitation of Liability
To the maximum extent permitted by applicable Indian law, Roommat Living's total aggregate liability to any User for any cause whatsoever shall not exceed the amount actually paid by that User to Roommat Living in the three months preceding the relevant claim.
10.5 Third-Party Interactions
Any interactions, agreements, or transactions between Users (between PG owners and seekers) are solely the responsibility of those parties. Roommat Living is not liable for any disputes, damages, losses, or injuries arising from such interactions.
10.6 Force Majeure
Roommat Living is not liable for any delay or failure to perform due to circumstances beyond its reasonable control, including natural disasters, government actions, internet outages, or civil unrest.
11. Dispute Resolution
11.1 User-to-User Disputes
Disputes between PG Owners and Seekers regarding accommodation, deposits, rent, or property condition are private matters. Roommat Living may offer informal mediation assistance but is not obligated to resolve such disputes and has no liability in connection with them.
11.2 Disputes with Roommat Living
Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Platform shall first be attempted to be resolved through good-faith negotiation within 30 days of written notice.
11.3 Arbitration
If negotiation fails, disputes shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996 (India). The arbitration shall be conducted in Gandhinagar, Gujarat, in the English and Gujarati language.
11.4 Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. The courts of Gandhinagar, Gujarat shall have exclusive jurisdiction over any matters not referred to arbitration.
12. Termination and Suspension
12.1 Termination by Roommat Living
Roommat Living reserves the right to suspend or permanently terminate any User account, with or without notice, for violation of these Terms, fraudulent activity, harmful behavior, or any other reason at our sole discretion.
12.2 Effect of Termination
Upon termination, your right to access the Platform ceases immediately. Active paid subscriptions will not be refunded unless termination is due to a proven technical failure by Roommat Living. Listings and profile data will be removed from public view.
12.3 Survival
Provisions of these Terms relating to intellectual property, indemnification, limitation of liability, dispute resolution, and governing law shall survive termination of your account or these Terms.
13. Indemnification
13.1 User Indemnity
You agree to indemnify, defend, and hold harmless Roommat Living, its founders, directors, employees, agents, and partners from and against any claims, damages, losses, costs (including legal fees), and expenses arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your Content uploaded to the Platform; (d) your violation of any third-party rights; or (e) any dispute between you and another User.
14. Miscellaneous Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy and any other policies linked on the Platform, constitute the entire agreement between you and Roommat Living regarding your use of the Platform.
14.2 Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms continue in full force and effect.
14.3 No Waiver
Roommat Living's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision in the future.
14.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without Roommat Living's prior written consent. Roommat Living may freely assign its rights under these Terms in connection with a merger, acquisition, or sale of assets.
14.5 Language
These Terms are written in English. In the event of any inconsistency between an English version and a translated version, the English version shall prevail.
14.6 Electronic Communications
By using the Platform and providing your contact details, you consent to receiving communications from Roommat Living via email, SMS, and WhatsApp for transactional, service, and promotional purposes. You may opt out of marketing communications at any time.
